## GP Practice Disciplinary Procedure
### Scope
This procedure applies to all employees of [Practice Name] and replaces any previous disciplinary policies.
### Informal Stage
For minor issues, a manager should hold an informal discussion before initiating formal proceedings. Document this conversation.
### Formal Stages
1. **Investigation** — appoint an investigating manager (not the line manager). Gather evidence before inviting to formal hearing.
2. **Formal Hearing** — minimum 5 working days notice. Employee has right to be accompanied (trade union rep or colleague).
3. **Outcome options:** No case to answer / First written warning / Final written warning / Dismissal with notice / Summary dismissal (gross misconduct only)
4. **Appeal** — must be offered within 5 working days of outcome. Appeal heard by senior/independent person.
### Gross Misconduct Examples (immediate suspension/dismissal)
- Theft, fraud, or falsification of records
- Physical violence or serious bullying
- Serious breach of patient confidentiality
- Wilful damage to practice property
- Being under the influence of alcohol/drugs at work
### Important Notes
- Always follow ACAS Code of Practice — employment tribunals apply a 25% adjustment for non-compliance
- Consult your HR advisor before any formal hearing
- Keep all documentation secure for 6 years
